Under the above Jersey legislation, employers have a duty to ensure that a person is not authorized to operate machinery unless they are fit to do so. Employers should assess the fitness of persons they intend to authorise, before and at regular intervals (minimum of every 5yrs) to confirm continued fitness. Re-assessment should also be undertaken following significant illness or injury, where prolonged or repeated absences from work are attributable to illness or injury, and on the reasonable request of the operator.
Assessment should involve confirmation of good general health, vision, hearing and absence of any specific medical disorders that might affect a person’s ability to operate machinery safely.
